The Kitewisp working agreement

This plain-language draft is meant to make the important parts easy to find. The owner should confirm the business details, effective date, and legal language before relying on it.

01 / what this covers

Scope and service relationship

These terms apply to your use of the Kitewisp website, account, and marketing services. Kitewisp is operated by Kite Wisp. When you use the service or start a paid subscription, you and Kite Wisp form a service relationship under these terms, subject to the owner's final review and any written order details we give you.

Kitewisp helps small businesses research, prepare, and schedule marketing work. The service is approval-first: you remain responsible for deciding what is approved for publication and for the claims your business makes.

02 / the monthly relationship

Subscription and billing

Plans are monthly subscriptions unless the checkout page or a written order says otherwise. The price shown for your selected plan is the recurring amount for each billing month. Your subscription renews automatically at that price until you cancel, unless we give notice of a change.

Payment is handled through the hosted payment processor shown at checkout. You authorize that processor to charge your chosen payment method for the subscription and any applicable taxes. Taxes, refunds, credits, and other payment exceptions are handled as applicable law and the final plan or order details require; the owner should confirm the specific policy before launch.

You can ask to cancel through Kitewisp support. Cancellation stops future renewals. The owner should confirm the exact timing, refund treatment, and any final billing details before publishing these terms.

03 / your account

Accounts and responsibilities

Give us accurate information and keep your account details current. Keep your password and sign-in methods confidential, and tell us promptly if you think your account has been used without permission. You are responsible for activity under your account and for making sure the people you invite have authority to act for your business.

You are also responsible for reviewing drafts, checking factual accuracy, securing any permissions needed for your business content, and following the laws and rules that apply to your marketing, industry, and location.

04 / use it responsibly

Acceptable use

Do not use Kitewisp to break the law, infringe someone else's rights, deceive or harass people, distribute malware or spam, bypass security, probe the service for vulnerabilities, or interfere with another customer's use. Do not submit passwords, secret keys, payment credentials, or sensitive information that Kitewisp does not need.

We may investigate apparent misuse and take reasonable steps to protect the service, customers, and other people. That can include removing content or limiting access while we review a concern.

05 / what you bring

Your content and publishing permission

You keep ownership of the business information, brand materials, photos, copy, offers, and other content you provide. You promise that you have the rights and permissions needed to give us that content and to use it for your business.

You give Kitewisp a limited, non-exclusive permission to host, store, copy, format, adapt, and process your content only as needed to provide the service, prepare drafts, and publish content you approve to the channels you connect or authorize. This permission ends when the content is no longer needed for those purposes, subject to reasonable backups and legal obligations. Kitewisp does not get ownership of your content merely because it helps process it.

06 / who owns what

Intellectual property

Kite Wisp and its licensors retain rights in Kitewisp, including its software, design, workflows, names, trademarks, and service materials. These terms give you permission to use the service during your subscription; they do not transfer those rights to you.

Subject to your payment and these terms, you may use the approved marketing work prepared for your business. Third-party materials, platforms, fonts, images, and channel accounts may have their own terms and rights, which remain your responsibility to review.

07 / honest expectations

Availability and results

Kitewisp depends on hosting, email, payment, social, search, and other third-party channels. Those channels can change, limit access, delay publishing, or become unavailable. We will take reasonable steps to keep the service working, but we do not promise uninterrupted or error-free availability.

Marketing is influenced by many factors outside Kitewisp's control. We do not promise a particular number of leads, calls, bookings, customers, revenue, ranking, reach, engagement level, or other specific business result. You decide whether and when to approve content, and you remain responsible for the outcomes and compliance of your marketing.

08 / limits of the service

Disclaimers and liability

To the extent allowed by law, Kitewisp is provided on an “as available” and “as is” basis. We disclaim warranties that the service will meet every expectation, remain available at all times, or produce a specific business outcome. Nothing here removes a protection or right that the law does not allow us to exclude.

To the extent allowed by law, Kite Wisp will not be responsible for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service. The owner should review and complete the liability cap, governing law, venue, and any required consumer-law language before launch; those details are intentionally not finalized in this draft.

09 / when the relationship ends

Suspension and termination

You may stop using Kitewisp and request cancellation through support. We may suspend or end access if you materially break these terms, fail to pay, create a security or legal risk, or if we discontinue the service. When practical, we will give notice and a chance to address the problem.

After termination, your permission to use the service ends. Provisions that should reasonably continue—such as payment obligations, ownership, disclaimers, and liability limits—will continue. The owner should confirm post-termination data access and deletion timing before launch.

10 / keeping the terms current

Changes to these terms

We may update these terms as Kitewisp changes or legal requirements develop. We will post the current version here and update the date above. For a material change, the owner should decide what notice is appropriate and how continued use or renewal will relate to the updated terms.
